WHAT TYPES OF EMPLOYMENT CONTRACTS ARE THERE?

There are two types of non-flexible employment contracts and four types of flexible employment contracts.

In the Netherlands we have the following two non-flexible employment contracts:

 

  • Fixed-term contract: This contract has no end date. There is often a probationary period during which you and/or the employer can decide to terminate the contract without giving any reason. After this you can terminate the contract by resigning with a notice period. An employer cannot just fire you, strict rules apply.
  • Temporary contract: Most jobs will start with a temporary contract with an end date that usually ends automatically. There is often a probationary period during which you and/or the employer can decide to terminate the contract without giving any reason. Your employer can decide to extend the contract after the end date of the contract. This is allowed a maximum of three consecutive times or for a maximum period of three years. After that you often get a fixed-term contract.

There are also four flexible employment contracts in the Netherlands:

  • Temporary employment contract: This is a flexible contract for someone who works as a temporary worker for a company. The employment agency is your formal employer. There is no notice period.
  • On-call contract/zero-hours contract: This is a contract stating that you will come to work when your employer calls you. You only receive wages for the hours you work. An example is a zero hours contract. There is no fixed number of hours agreed upon. You as an employee are not obliged to work a minimum number of hours and your employer is also not obliged to offer a minimum number of hours of work.
  • Model agreement: This contract is often used between freelancers and the client for a specific assignment. When the assignment is completed, the contract is immediately terminated.
  • Secondment agreement/interim contract: This is a contract in which the employee temporarily works for a client, but is under contract with a secondment agency or another employer.
